The opinion of the court was delivered by The Division of Vehicles, Kansas Department of Revenue (KDR or
the department) appeals a district court determination that the
department's administrative suspensions of drivers' licenses
under the Kansas implied consent law, K.S.A. 8-1001, were void as
violations of due process of law. Six separate cases have been
consolidated on appeal and transferred to the Supreme Court from
the Court of Appeals. The six drivers (hereinafter petitioners or appellees) were all
stopped by law enforcement officers who suspected each of driving
while under the influence of alcohol (DUI). Following each
arrest, the various arresting officers completed a "LAW
